Terms of Service

These terms are an agreement between you and Jon Aaron, who operates This Family ("we", "us"). They cover our website, apps and web app (the "Service"). By using the Service you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. Who can use This Family

2. Your account

Keep your sign-in methods (your email account, phone and devices) secure, and tell us at support@thisfamily.app if you think someone else has used your account. You're responsible for what happens in your account, except where it's our fault. Don't sign in as someone else or share an account.

3. Your content

You own the stories, photos, videos, recordings, messages and other content you share ("your content"). To run the Service, you give us a limited, non-exclusive, worldwide, royalty-free license to store, copy, process (for example, resize a photo or transcribe a recording), and display your content to the people your settings allow. This license is only for operating and improving the Service for you and your family, and it ends when your content is deleted, except for copies your family keeps under section 8 or that we must keep by law.

Only share content you have the right to share. When you add information about other people, such as relatives in the tree, be accurate and respectful, and remember that they can ask us to correct or remove it.

4. Family rules

This Family is a place for families. When you use it, don't:

We may remove content or limit or close accounts that break these rules. You can report content or behavior in the app or by email, and we'll review it.

5. Privacy and safety tools

Blocking, hidden relationships, safety mode, content ratings and parental controls help you control what others can see. They are designed carefully, but no tool can control what someone does outside This Family, such as taking a screenshot or telling another relative. If you are in danger, contact local emergency services.

6. AI features

Some features use AI to suggest ratings, prompts, summaries, transcripts and narration. AI can make mistakes, so review AI output before relying on it. A copy of a person's voice is made only with that person's recorded consent, and only that person (or someone they authorize) may use it.

8. Leaving This Family

You can download your content or delete your account at any time (see how). When you delete your account, you choose for each of your posts whether to delete it or give it to your family. Content that relatives have saved or that belongs to them isn't deleted with your account.

We may suspend or close an account that seriously or repeatedly breaks these terms, or if the law requires it. If we close your account for any other reason, or stop offering the Service, we'll give you reasonable notice and a chance to download your content.

Sign-in codes sent by text message are covered by our SMS Terms, which are part of these terms.

10. Disclaimers

We work hard to keep This Family available and your content safe, but the Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement. Keep your own copies of anything irreplaceable. Family tree information comes from family members, and we don't verify it.

11. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not apply to you.

12. Indemnity

If someone brings a claim against us because of content you shared or because you broke these terms, you agree to cover our reasonable costs of that claim, to the extent the law allows.

13. Governing law and disputes

These terms are governed by the laws of the State of Utah, USA, without regard to its conflict of law rules. Please contact us first so we can try to resolve any problem informally. Any dispute that can't be resolved informally will be decided by the state or federal courts located in Utah, and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead. If you live outside the United States, this doesn't take away protections your local law gives you.

14. Changes

We may update these terms as This Family grows. We'll change the date at the top, and for significant changes we'll tell you in the app or by email before they take effect. If you keep using the Service after that, the new terms apply.

15. General

These terms, the Privacy Policy and the SMS Terms are the whole agreement between you and us about the Service. If a part of these terms can't be enforced, the rest still applies. If we don't enforce a part right away, we haven't given up the right to enforce it later. You may not transfer these terms without our consent; we may transfer them to a new owner of This Family.
